Terms of Use Agreement

1. Agreement. This is an “Agreement” between you, the individual or other entity visiting or using the c4re Web Sites, and Chesley Real Estate Services (CRES). This Agreement governs your use of the c4re Web Sites.

 

2. Binding. By using the c4re Web Sites you represent that you have read, approved, accepted, and agree to be bound by all of the terms, conditions, restrictions, notices, and provisions of this Agreement by your act of using the c4re Web Sites.

 

3. Company Information.  Chesley Real Estate Services (CRES), is a sole proprietorship owned and operated by William H. Chesley and Susan M. Chesley (WSC).

 

4. Doing Business As. We do business as Chesley Real Estate Services, William H. Chesley, or Susan M. Chesley. Other words, abbreviations, or internet addresses used, are not intended as “Doing Business As” designations (DBA), unless specifically so stated herein. “c4re” is an abbreviation for the slogan “Chesley For Real Estate” and is not intended as a DBA.

 

5. Web Sites. We operate, maintain, or have hosted, various web sites which include www.c4re.com, www.c4re.net, www.c4re.org, www.c4re.us, or from time to time other web sites or web pages, which are collectively referred to as the “c4re Web Sites”.

 

6. Additional Terms. The individual c4re Web Sites may contain additional terms, conditions, restrictions, notices, and provisions which also govern the use of that individual c4re Web Site. To the extent that there is a conflict between this Agreement and those additional terms, this Agreement shall be controlling and supersede any such conflicting terms.

 

7. Visitor. Each individual or other entity, visiting or using the c4re Web Sites, is individually or collectively referred to as “You” or “Visitor”.

 

8. Privacy.  All visitor information obtained by CRES remains confidential except: to complete transactions on behalf of customers in the ordinary course of business; as authorized by visitor; or, as may be required by law. We do not sell the information obtained to third parties.

 

9. eMail.  All eMail transmitted through the c4re Web Sites, and all other eMail transmitted to and from CRES, may be reviewed by CRES. Such eMail should not be used for any of the following: personal use; illegal purposes; formal notices; or, formal communications. All notices and communications required by law or contract to be in writing should not be sent by email, but instead be sent by traditional methods such as United States Postal Service, Federal Express, Airborne, or other carrier formally registered in the United States.

 

10. Availability. All properties and services are subject to: 1) terms and conditions; and, 2) without notice: removal from availability; prior sale; and, change of terms, conditions, and price.

 

11. Competition. If your property is listed with another broker, or if you have executed an exclusive buyer representation agreement, this is not intended as a solicitation.

 

12. Prior Sales. Some or all of the properties referred to in relationship to WSC’s real estate experience, may have been marketed prior to their association with Prudential California Realty. Whimsey Castle and Enchanted Forest Park were landmarks that were part of an entire property of which the subdivision was a part; however, the Castle and Park were not included in subdivision sales. These landmarks were located adjacent to the actual subdivision located across a public highway. The picture of Thompson Valley includes portions of adjoining properties that were not included in the development of Thompson Valley.

 

13. Prudential California Realty Affiliation. William H. Chesley and Susan M. Chesley are affiliated with Prudential California Realty respectively as broker associate and referral associate. William H. Chesley is neither Corporate Counsel nor Broker of Record for Prudential.

 

14. Prudential. Prudential California Realty is an independently owned and operated member of the Prudential Real Estate Affiliates, Inc. Prudential Real Estate Brokerage Services are offered through the network of independently owned and operated franchisees of The Prudential Real Estate Affiliates, Inc., a subsidiary of The Prudential Insurance Company of America.

 

15. Information Not Guaranteed.  Information contained in the c4re Web Sites has not been verified, is not guaranteed, and is not to be taken as legal or other advice for any specific situation. Visitors must consult the appropriate professional (financial, legal, real estate, or other) in order to make the appropriate decisions. Visitors must verify all information prior to making decisions based thereon.

 

16. Links.  We do not endorse other sites that we have linked to. The links are provided only as a convenience for Visitors. Upon entering all sites, Visitors should immediately review the Notices, terms and conditions of use, and all other policies of the sites prior to continuing. Information contained in linked sites has not been verified and is not guaranteed.

 

17. TrademarksThe Trademarks and Logos are the property of the respective owners thereof.

 

18. Limitation of Liability.  CRES shall not be responsible for any typographical errors, misinformation, or misprints and shall be indemnified for same by Visitors.

 

19. Equality.  We support Equal Housing Opportunity, Equal Employment Opportunity, and Equal Lifestyle Opportunity.

 

20. Modification of Terms. You are responsible for regularly reviewing this Agreement and any additional agreement posted on any c4re Web Site. Your use of the c4re Web Sites on or after the updated date represents your acceptance of such updated Agreement.
